Welcome to Tutti (the “Platform”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Creator”, “User”, or “you”) and Velocity1, LLC (“Company”, “we”, “us”, or “our”). By registering an account or participating in any campaign on Tutti, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. Scope of Service
Tutti is a platform that facilitates promotional campaigns by connecting Brands with content creators. The Platform tracks performance data on Twitter/X to determine rewards and payouts.
2. Account Registration and Security
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Content Guidelines & Creator Obligations
- Authenticity: Creators must produce authentic, value-driven content. Purely promotional “spam” or misleading claims are prohibited.
- Compliance with X Rules: All content must comply with Twitter/X’s Terms of Service and Community Guidelines.
- Conditional Brand Requirements: Content must include specified mentions (e.g., @BrandName) and promotional links only if such requirements are explicitly dictated in the specific campaign brief. If no such requirements are stated, the Creator maintains creative discretion.
- Prohibited Conduct: Plagiarism, copyright infringement, and the use of “AI-heavy” content that lacks original value are strictly forbidden.
4. Performance Verification & Fairness Algorithm
- Data Source: Performance metrics are primarily based on official Twitter/X Analytics.
- Proprietary Processing: To ensure a fair distribution of rewards and protect the integrity of the campaign, Tutti utilizes a proprietary algorithm to process raw data. This process includes:
- Weighting and Normalization: Adjusting data to prevent a single participant from monopolizing the majority of the total reward pool.
- Peak-Shaving (Clipping): Identifying and recalibrating abnormally high spikes in data that deviate from standard engagement patterns.
- Finality of Data: Payouts are calculated based on the results of this algorithm. By participating, you agree to accept Tutti’s processed data as the final basis for compensation.
5. Anti-Fraud Policy
Tutti maintains a zero-tolerance policy regarding fraudulent activity and inorganic growth.
- Prohibited Metrics: The use of bots, click farms, automated engagement scripts, or any service designed to artificially inflate impressions is strictly prohibited.
- Suspicious Activity: In cases where our algorithm detects suspicious spikes or anomalies indicative of non-human engagement, Tutti reserves the right to apply peak-shaving adjustments or disqualify the content entirely.
- Consequences: Confirmed fraud will result in the immediate forfeiture of all earnings, permanent account suspension, and potential legal action.
6. Intellectual Property
- Platform Content: All software, design, and proprietary algorithms on the Platform remain the exclusive property of Velocity1, LLC.
- User License: By posting content for a campaign, you grant the Brand and Velocity1, LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content for promotional and archival purposes.
7. Confidentiality
Survival of Obligations: You agree to keep all non-public information regarding campaign briefs, brand data, and Platform mechanics confidential. This obligation shall survive for three (3) years after the termination of your use of the Platform.
8. Limitation of Liability & Disclaimers
- As-Is Basis: The Platform is provided “as-is.” We do not guarantee continuous, uninterrupted access.
- Platform Risks: Velocity1, LLC is not liable for service interruptions caused by Twitter/X’s algorithm changes, server failures, or account suspensions.
- No Commercial Guarantee: We do not guarantee specific conversion rates or commercial success for the Brands.
9. Dispute Resolution
Any dispute arising from these Terms shall first be settled through friendly negotiation. If negotiation fails, disputes shall be submitted to the court of competent jurisdiction in the location of the defendant.
